These General Terms and Conditions of Sale are entered into between, on the one hand, SKINCARE AGENCY, a simplified joint-stock company (SAS) with a capital of €39,270, registered with the Paris Trade and Companies Register under number 894 968 874 000 12 , having its registered office at 17, RUE DE LA TREMOILLE 75008 Paris, and on the other hand, any person who has made a purchase on the website, hereinafter referred to as "the Customer". Any purchase on the website www.skincareagency.shop (hereinafter the "Site") automatically implies acceptance of all these conditions, which the Client acknowledges having read prior to placing their order. 

Article 1: Buyer's Capacity
 The Customer who purchases on the Site declares that they are legally capable of entering into these general terms and conditions of sale.

Article 2: Price
All prices displayed on the Site are inclusive of all taxes. Product prices are listed in euros. SKINCARE AGENCY reserves the right to change its prices without prior notice, and the prices applied to the Customer are those displayed on the Site at the time of their order. Goods remain the full property of SKINCARE AGENCY until full payment of the amount due from the Customer has been received.

Article 3: Presentation of the articles
 SKINCARE AGENCY strives to present and describe its products as accurately and precisely as possible.

Article 4: Order
The order is confirmed once payment has been accepted by SKINCARE AGENCY . SKINCARE AGENCY reserves the right to refuse an order if the Customer already has a dispute with SKINCARE AGENCY or if SKINCARE AGENCY believes the Customer poses a risk of defaulting on payment. In such cases, SKINCARE AGENCY reserves the right to request additional information from the Customer if deemed necessary, such as proof of identity or address. If the Customer does not respond within 5 days of placing the order, the order and payment will be cancelled. SKINCARE AGENCY undertakes to fulfill orders received, subject to availability.

Article 5: Delivery of items
 When SKINCARE AGENCY has received payment for the Order, it will deliver the Product to the Customer in accordance with the chosen delivery method, to the delivery address indicated by the Customer within 48 hours for orders of less than 10 products, and a maximum of 7 days for orders of more than 10 products.

SKINCARE AGENCY cannot be held responsible for deliveries made due to human error on the part of the Customer, including, but not limited to, an incorrect or incomplete delivery address. The Customer is solely responsible for ensuring that the delivery address information is accurate, precise, and complete.

SKINCARE AGENCY shall not be held liable for any damage, loss, or expense resulting from delays, inaccurate deliveries, or non-delivery of Products due to such errors. Any expenses arising from these errors shall be borne by the Client.

The estimated delivery time for the Product is specified in the shipping policy terms and conditions available at the following address: www.skincareagency.shop . The indicated delivery time is an estimate and SKINCARE AGENCY cannot be held responsible for any delays or damages resulting from a delayed delivery of the Product.

SKINCARE AGENCY may update the delivery time in the event of any changes.

The Customer is responsible for all costs associated with the delivery of the Product. SKINCARE AGENCY assumes no liability for any additional fees or costs related to the delivery of the Product. The risk of loss or damage to the Product passes to the Customer upon delivery of the Product to the delivery address specified by the Customer.

Article 6: Payment

A. The different payment methods
Once the Customer confirms their order, they accept all the General Terms and Conditions of Sale. The Customer pays on the website. www.skincareagency.shop :

  • by bank card (CB, Visa, Mastercard, Apple Pay or Google Pay);
  • via PayPal

B. 3D Secure Payment
 Your order may be subject to 3D Secure verification. 3D Secure is an authentication payment system that guarantees optimal security for your online purchases. During payment, your bank verifies the cardholder's identity before authorizing the transaction.

How 3D Secure verification works:
After validating your bank details, you will be redirected to your bank's website. In the 3D Secure window that appears, the authentication process to follow is specific to each bank. You may be asked to:

  • Enter your date of birth
  • Enter a code received by SMS
  • Or even to answer a personal question.

This exchange of information between you and your bank is secure. It guarantees the identity of the cardholder. For any questions about the 3D Secure code (obtaining, losing, changing, etc.), contact your bank directly.

WARNING: After 3 failed authentication attempts, your transaction will be cancelled. Your card will be blocked. Contact your bank.

C. Payment Verification
 To protect itself against fraudulent practices, SKINCARE AGENCY verifies orders placed on its website. As part of this verification process, our customer service department may request certain documents necessary to validate your order, including proof of address in your name or in the name of the person indicated for the delivery address, etc.

Article 8: Secure Payment - Protection of Bank Transactions
SKINCARE AGENCY entrusts the security of its transactions to the payment provider STRIPE . Payment is secured through our partner STRIPE 's online payment system. Bank details are transmitted over the internet only in encrypted form, meaning they are coded to be completely unreadable and are therefore never stored by SKINCARE AGENCY.

Article 9: Respect for privacy
 All personal data provided by the Client on the website www.skincareagency.shop This data is processed electronically for the purpose of order processing and delivery, and for suggesting products tailored to the customer's needs. This data is exclusively reserved for SKINCARE AGENCY.

Article 10: Returns, Exchanges

10.1 Online Purchases www.skincareagency.shop 
For all purchases on the website www.skincareagency.shop , the Customer has a period of 14 days from the day of receipt of their order to exercise their right of withdrawal without giving a reason.

In accordance with Article L.121-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods that have been unsealed by the Customer after delivery and that cannot be returned for reasons of hygiene or health protection (e.g., skincare products, makeup, etc.). Any goods returned to SKINCARE AGENCY in violation of Article L.121-28 of the French Consumer Code will be returned to the Customer at SKINCARE AGENCY's expense, without the Customer being entitled to any compensation whatsoever.

To exercise the right of withdrawal, the Client must notify SKINCARE AGENCY (17 rue de la Tremoille, 75008 Paris – contact@skincareagency.com) of their decision to withdraw before the expiry of the period by means of an unambiguous statement (for example, a letter sent by post or email).

The Customer may use the withdrawal form template shown below:

In the event of withdrawal by the Customer, SKINCARE AGENCY will reimburse the amount of their order (excluding delivery costs) no later than fourteen days from the day on which SKINCARE AGENCY is informed of their decision to withdraw.

SKINCARE AGENCY may delay the refund until the returned products are received.

When the order was accompanied by a gift offered to the Customer under conditions – for example, a gift offered only if a minimum order amount was reached – and the Customer no longer meets the conditions necessary to obtain the gift due to the exercise of the right of withdrawal by the Customer, the gift must be returned to SKINCARE AGENCY with the returned products and SKINCARE AGENCY may defer the refund until receipt of the gift.

SKINCARE AGENCY will issue the refund using the same payment method as the initial transaction, unless the Client expressly agrees to a different method and this refund does not incur any costs for the Client.

The Customer must return the goods to SKINCARE AGENCY, 17 rue de la Tremoille, 75008 Paris, France, no later than fourteen days after notifying SKINCARE AGENCY of their decision to withdraw from the contract. This deadline is considered met if the Customer returns the goods before the fourteen-day period expires.

The Customer will be responsible for the direct costs of returning the item.

SKINCARE AGENCY advises the Client to choose a shipping method with a tracking number. Without a tracking number, SKINCARE AGENCY will not accept any claims.

The Client is only liable for any depreciation of the goods resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the goods.

10.2 In-store purchases SKINCARE AGENCY
Product refunds are not available at SKINCARE AGENCY. Therefore, when a customer makes a purchase at SKINCARE AGENCY, they cannot obtain a refund for the products purchased.

In store, the Customer has a period of fourteen (14) days to make an exchange of a value equal to or greater than the product initially purchased (if applicable, subject to payment of the difference), or obtain a credit in the form of a gift card valid for 1 year.

Shop in store and get home delivery
 If a product is not available in store, you have the option of having it delivered to your home.

Product refunds are not available at SKINCARE AGENCY clinic.
If upon receipt the product does not suit you, you have a period of fourteen (14) days to return to the SKINCARE AGENCY clinic to make an exchange of a value equal to or greater than the product initially purchased (if applicable, subject to payment of the difference), or obtain a credit in the form of a gift card valid for 1 year.

Article 11: Promotional Codes
 Promotional codes apply only to full, undiscounted prices and do not apply to limited editions. Promotional codes cannot be combined with each other or with vouchers. Promotional codes can be used once per customer account unless otherwise instructed by SKINCARE AGENCY. These codes are non-refundable in the event of an exchange.

Article 12: Intellectual Property
All elements present on this website, whether visual, textual, or audio, are the exclusive property of SKINCARE AGENCY, or the relevant intellectual property rights holder, and are therefore protected by intellectual property law and copyright law. Consequently, any reproduction of the SKINCARE AGENCY trademark or the website, in whole or in part, is strictly prohibited.

You may link to our website provided you do so fairly and in a manner that does not damage our reputation or take advantage of our brand. However, you may not create a link that suggests any form of association where none exists. Furthermore, you may not link to our website from any website that does not belong to you. We reserve the right to remove links without notice.

Article 13: Limitation of Liability
SKINCARE AGENCY shall not be liable to third parties for any indirect, special, or incidental damages arising from the Client's negligence, failure, or clumsiness, or resulting from the Client's misuse of any of the products offered for sale on the website. www.skincareagency.shop . Regarding access to the Site, its consultation, the ordering, payment, delivery, and service processes, SKINCARE AGENCY is only bound by an obligation of means. SKINCARE AGENCY cannot be held liable for any inconvenience or damage inherent to the Internet network, including any disruption of the connection or any computer virus intrusion. Furthermore, SKINCARE AGENCY is exempt from all liability for any event deemed a force majeure under the jurisprudence of the French Court of Cassation. Finally, SKINCARE AGENCY's liability is limited to the amount of the Customer's order.

Article 14: Legal Guarantee
 The products sold on the site www.skincareagency.shop are subject to the legal guarantee of conformity set out in Articles L.217-4 et seq. of the Consumer Code and to the guarantee against hidden defects set out in Articles 1641 et seq. of the Civil Code.

14.1 Legal guarantee of conformity

Article L. 217-4 of the Consumer Code: The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was the seller's responsibility under the contract or was carried out under the seller's supervision.
Article L. 217-5 of the Consumer Code : Goods conform to the contract: 1° If they are fit for the purpose usually expected of similar goods and, where applicable: - if they correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model; - if they possess the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling; 2° Or if they possess the characteristics defined by mutual agreement between the parties or are fit for any special purpose sought by the buyer, made known to the seller and which the latter has accepted.
Article L. 217-12 of the Consumer Code : The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods.

14.2 Warranty against defects in the item sold

Article 1641 of the Civil Code: The seller is bound by a warranty against hidden defects in the thing sold which render it unfit for its intended use, or which so diminish that use that the buyer would not have acquired it, or would have given only a lower price, if he had known of them. Article 1648 of the Civil Code: The action resulting from latent defects must be brought by the buyer within two years from the discovery of the defect.

When acting under the legal guarantee of conformity, the Customer:

  • benefits from a period of two years from the delivery of the goods to take action;
  • may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code;
  • is exempt from providing proof of the existence of the non-conformity of the goods during the twenty-four months following delivery of the goods.

The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.

The Customer may decide to implement the guarantee against hidden defects in the thing sold within the meaning of article 1641 of the civil code and may in this case choose between the termination of the sale or a reduction of the sale price in accordance with article 1644 of the civil code.

Article 15: Disputes - Claims - Information

Article 16: Applicable Law

The Customer fully accepts and acknowledges that French law governs these General Terms and Conditions of Sale, as well as any dispute or litigation that may arise between the Customer and SKINCARE AGENCY. Furthermore, the user (or Customer) agrees that in the event of a dispute arising from a visit to or purchase on the website, French law shall apply. www.skincareagency.shop , the French courts are recognized as having jurisdiction.

Article 17: Modification of the CGU/CGV

SKINCARE AGENCY reserves the right to modify and update these Terms and Conditions without prior notice. SKINCARE AGENCY will publish the new Terms and Conditions on its Website. To stay informed of any changes, SKINCARE AGENCY advises the Customer to review the Terms and Conditions on the Website regularly. The Customer's order will be subject to the Terms and Conditions in effect at the time the order is placed.

a. Order: When you place an order, we record your data to process it efficiently and ship the purchased products.
